All car buyers negotiate with car dealers.Before stepping foot inside a dealership you should know your rights as a consumer.The Sale of Goods Act is full of useful information you will need as a car buyer.Below you will find the steps you need to follow in case a car dealer tries to violate your rights as a consumer.

 

LEGISLATION

 

The Sale of Goods Act covers a customer's rights as they pertain to vehicle purchase.It also defines a car dealership's responsibilities should a vehicle need to be returned.

 

AGREEMENT OR CONTRACT

 

Vehicles are defined by their make,model,color and design among other things.These and other details must be listed on a contract.The condition or quality of the vehicle must also be listed.The contract will serve as evidence should you need to prove you were defrauded.You have the right to sue if your vehicle should become unreliable within a few months of purchase.The contract will also be useful when applying for vehicle insurance.

 

You should make sure that your signature as well as the car dealers(Do you know that the term in Danish is Bil forhandlere) appears on the contract.The UCC(Uniform Commercial Code) states that any item over 0 must have a contract with both the buyer and seller's signature.If you do not have a contract with both signatures you will not be able to sue should the car dealer violate your rights.

Any consumer who purchases a vehicle has the option to return it within six months if the item shows signs of prior damage or other technical problems.You can get a replacement,return the vehicle or request a refund,as long as the damage was not caused by a car accident.If the dealership refuses to honor the contract and you feel as if your rights have been violated,you may sue for what is considered a breach of warranty.

 

By law dealerships must disclose all details regarding the vehicles they are selling.Whether these issues are safety concerns or minor cosmetic damage.As a consumer you should know the contents of the Sale of Goods Act to protect your rights.By knowing your rights you will be able to fight for justice and avoid fraud should any of these issues arise between you and the car dealer.

 

It is very important to remember that any claim or prosecution can be time consuming and costly.

Not only will you have to pay for legal representation but you may well be without a car while the matter is settled in court and this could take months or even years.

 

For this very reason it is also your duty of care to have the car checked out professionally. If the dealership refuse for an independent inspection to be carried out then walk away. There would be some reason why they refused. Follow your gut instinct as you would normally be right. Ensure you have done all you can to have the car checked out and prevent extra cost and time wasted in disputes as normally it will you who pays the higher price in the long run.
